Nice "theory." Pity the evidence is 100% missing. And even if there was such evidence, it would have zero bearing the criminal liability for ALL the foreseeable consequences of mining the dam, and indeed invading Ukraine.

In law if the result (whole dam blowing) is a foreseeable result of blowing up the dam, then it makes no difference.
If you get into your car drunk, and you kill many children, you're 100% responsible. Because drunk driving is the original sin, and it's foreseeable that driving while drunk kills people.
If you plant mines in a nuclear power plant or on a dam and there's an "accident" it's not an accident. It's the foreseeable result of your actions. Unless you're under the age of six. We're not dealing with children here. Every Ruschist soldier is a responsible adult.
In law EVERY foreseeable consequence of the full-scale invasion starting on 24th Feb is 100% Ruschia's responsibility. In law.
And everything which has occurred in Ukraine since Feb 24th 2022 is and was foreseen. "Negligence" "lack of intentionality" "mistakes" "poor execution" "surprizes" carry NO weight as mitigating defences for Ruschia and every single one of the Ruschists occupying Ukraine and supporting the genocide.
I've seen a lot of "knowing" commentators earnestly telling us information they could only know if they have seen into the minds of the people who gave and executed the order to destroy the dam (and MH17).
These Russia-Understanders want to believe the Ruschists aren't as bad as they are.
And they're fixing the data to coordinate with that hope. It's Disinfolklore masquerading as Copium.

In reality, Russia has been, uncontroversially, engaged in a full-scale war of Aggression since Feb 24th 2022.
A dam fully within Ruschia's control, within the definitions of the Geneva Conventions, blew up, after Ruschia admitted mining the dam, AND after Ruschia threatened to blow it up.

On the Blue Side: International law and all states defending it.
On the Red Side: Ruschia.
Framing Ruschia's war of aggression as a War against Ukraine leads to framing errors, which advantages Russian Disinfolklore.
Ruschia's war is against the UN Charter, Genocide Convention, and the Laws of War.
